Abstract | This report examines the problem of school facility disparities in Michigan and the prospects of litigation to address this problem. First, the authors briefly review evidence of the important impact of school facilities on students, teachers, and communities. They then provide an overview of litigation aimed at state school finance systems across the U.S. The authors examine Michigan law as it relates to these issues. They present data reflecting Michigan's capital facilities problem and consider how it might be viewed by the courts. They conclude by noting the essential role of the courts, acting in concert with the state's legislative and executive branches, in establishing a policy context in which Michigan can finally address its school facility problem.
